ACCEPTABLE USE POLICY

This Acceptable Use Policy (“AUP”) applies to your access to and use of any websites, applications, tools, or services made available by Percipient LLC (“Percipient,” “we,” “us,” or “our”), including percipient.co, percipient.app, legalhold.app, and certera.ai (collectively, the “Services”). This AUP is incorporated by reference into our Terms of Service applicable to each Service. Capitalized terms not defined here have the meanings given in those Terms.
You agree not to use the Services to:
- Violate Law. Violate any applicable law, regulation, court order, or third-party right, or facilitate or encourage any unlawful activity.
- Infringe Rights. Upload, submit, transmit, or generate content that infringes, misappropriates, or violates any intellectual property, privacy, publicity, confidentiality, contractual, or other right of any person or entity.
- Submit Restricted Data. Submit any of the following to the Services unless expressly permitted in a written agreement with Percipient:
- protected health information subject to HIPAA;
- payment card data subject to PCI-DSS (other than data submitted to our payment processor for billing);
- consumer financial information subject to GLBA;
- student records subject to FERPA;
- biometric identifiers, government-issued identification numbers, or social security numbers;
- classified, export-controlled, or otherwise legally restricted information; or
- any other category of sensitive personal data for which the Services have not been authorized.
- Harm Systems. Attempt to gain unauthorized access to the Services, other users’ accounts, or any related systems or networks; introduce viruses, malware, worms, trojans, or other harmful code; probe, scan, or test the vulnerability of the Services; or interfere with or disrupt the integrity or performance of the Services.
- Misuse AI Outputs. Use any output of the Services to (a) train, fine-tune, or develop a competing AI model or service; (b) represent AI-generated content as human-authored where doing so would be deceptive or misleading; or (c) provide legal advice without appropriate professional review and judgment.
- Abuse Comparison Features. Manipulate, falsify, or attempt to game any rating, ranking, preference, or evaluation feature of the Services, including by submitting automated, fraudulent, or coordinated inputs intended to skew evaluation results.
- Scrape or Reverse Engineer. Use any robot, scraper, crawler, spider, or other automated means to access the Services, except through any API we have expressly authorized; or reverse engineer, decompile, or attempt to derive the source code, model weights, training data, or underlying algorithms of the Services.
- Generate Harmful Content. Use the Services to generate, distribute, or facilitate content that is harassing, threatening, defamatory, fraudulent, discriminatory, sexually exploitative of minors, or otherwise unlawful or harmful.
- Misrepresent Identity. Impersonate any person or entity, misrepresent your affiliation with any person or entity, or create accounts using false, misleading, or unauthorized information.
- Resell or Sublicense. Resell, sublicense, lease, time-share, or otherwise make the Services available to any third party, except as expressly permitted by your applicable Terms.
We may, in our sole discretion and without prior notice, suspend or terminate access to the Services, remove content, or take any other action we reasonably consider appropriate if we believe you have violated this AUP or are otherwise misusing the Services. We may also update this AUP from time to time by posting a revised version, and your continued use of the Services after a revision becomes effective constitutes acceptance of the revised AUP.
